5 Conditions of use

Emaanmall and its affiliates (“Emaanmall”) offer website features, products, and services when you visit or shop at Emaanmall.com, use Emaanmall’s products or services, access mobile applications, or utilize software provided by Emaanmall in connection with these services (collectively referred to as “Emaanmall Services”). By using Emaanmall Services, you agree to the following terms on behalf of yourself, your household members, and anyone else using the services under your account.

6 Please read these conditions carefully

We provide a variety of Emaanmall Services, and additional terms may apply in certain cases. When you use an Emaanmall Service (for example, Your Profile, Gift Cards, Emaanmall Video, Your Media Library, Emaanmall devices, or Emaanmall applications), you will also be subject to the specific guidelines, terms, and agreements applicable to that service (“Service Terms”). In the event of any inconsistency between these Conditions of Use and the Service Terms, the Service Terms will take precedence.

8 ELECTRONIC COMMUNICATIONS

When you use Emaanmall Services, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Emaanmall Services, such as our Message Center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

9 COPYRIGHT

All content included in or made available through any Emaanmall Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Emaanmall or its content suppliers and protected by Pakistan and international copyright laws. The compilation of all content included in or made available through any Emaanmall Service is the exclusive property of Emaanmall and protected by Pakistan and international copyright laws

10 TRADEMARKS

In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Emaanmall Service are trademarks or trade dress of Emaanmall in the Pakistan and other countries. Emaanmall’s trademarks and trade dress may not be used in connection with any product or service that is not Emaanmall’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Emaanmall. All other trademarks not owned by Emaanmall that appear in any Emaanmall Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Emaanmall.

11 LICENSE AND ACCESS

Subject to your compliance with these Conditions of Use and any Service Terms, and your payment of any applicable fees, Emaanmall or its content providers grant you a limited, non-exclusive, non-transferable, non sublicensable license to access and make personal and non-commercial use of the Emaanmall Services. This license does not include any resale or commercial use of any Emaanmall Service or its contents; any collection and use of product listings, descriptions, or prices; any derivative use of any Emaanmall Service or its contents; any downloading, copying, or other use of account information for the benefit of any third party; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you under these Conditions of Use or any Service Terms are reserved and retained by Emaanmall or its licensors, suppliers, publishers, rights holders, or other content providers. No Emaanmall Service, nor any part of any Emaanmall Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent from Emaanmall. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Emaanmall without express written consent. Additionally, you may not use meta tags or other “hidden text” utilizing Emaanmall’s name or trademarks without express written consent. Misuse of Emaanmall Services is prohibited. You may use Emaanmall Services only as permitted by law. The licenses granted by Emaanmall terminate if you fail to comply with these Conditions of Use or any Service Terms.

11.1 YOUR ACCOUNT

You may need your own Emaanmall account to use certain Emaanmall Services, and you may be required to be logged in to the account and have a valid payment method associated with it. If there is an issue charging your selected payment method, we may charge any other valid payment method linked to your account. Visit Your Payments to manage your payment options. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password. Emaanmall does sell products for children, but they are sold to adults who can purchase using a credit card or other approved payment methods. If you are under 18, you may use Emaanmall Services only with the involvement of a parent or guardian. Parents and guardians may create profiles for teenagers within their Emaanmall Household. Alcohol-related listings on Emaanmall are intended for adults. You must be at least 21 years of age to purchase alcohol or use any site functionality related to alcohol. Emaanmall reserves the right to refuse service, terminate accounts, revoke your rights to use Emaanmall Services, remove or edit content, or cancel orders at its sole discretion.

11.2 REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTEN

You may post reviews, comments, photos, videos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam” or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. Emaanmall reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant Emaanmall a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Emaanmall and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Emaanmall for all claims resulting from content you supply. Emaanmall has the right but not the obligation to monitor and edit or remove any activity or content. Emaanmall takes no responsibility and assumes no liability for any content posted by you or any third party

11.3 INTELLECTUAL PROPERTY COMPLAINTS

12 Report Infringement

12.1About Emaanmall’s Report Infringement Form

Emaanmall’s Report Infringement form is intended for use by intellectual property rights owners and their agents to notify Emaanmall of alleged  intellectual property infringements such as copyright and trademark concerns. If you are not an intellectual property rights owner or their agent, Emaanmall will not be able to process complaints submitted through this form. Please report your concerns to Emaanmall through the appropriate venue:

• Sellers may use this Contacat Us to report inappropriate listings, other sellers, policy violations, etc.
• Buyers may use this Contact Us to report problems with orders, seller policy violations, etc.

12.2We Do Not Enforce

Product detail page ownership and image restrictions: When a product detail page is created, it becomes a permanent catalog page on Emaanmall that will remain even if the creator’s inventory sells out. Additionally, when you add your copyrighted image to a product detail page, you grant Emaanmall and its affiliates a non-exclusive, worldwide, royalty-free, perpetual, irrevocable right to exercise all rights of publicity over the material. Other sellers can list their items for sale against pages or copyrighted images that you have used. However, we do require sellers to list only against product detail pages that exactly match their items. If you believe sellers are listing against product detail pages that do not exactly match their items, we ask that you report the violation directly by using the Contact us form If your copyrighted image has been added to our catalog without your consent, please start a report. Exclusive or selective distribution: Emanmall respects a manufacturer’s right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Emaanmall to assist in enforcement activities. Please review the intellectual property right owner to learn more about different infringement types.

12.3 RISK OF LOSS

All purchases of physical items from Emaanmall are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

12.4 RETURNS, REFUNDS AND TITLE

Emaanmall does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Emaanmall does not take title to the refunded item. For more information about our returns and refunds,

12.5 PRODUCT DESCRIPTIONS

Emaanmall attempts to be as accurate as possible. However, Emaanmall does not warrant that product descriptions or other content of any Emaanmall Service is accurate, complete, reliable, current, or error-free. If a product offered by Emaanmall itself is not as described, your sole remedy is to return it in unused condition.

12.6 PRICING

List Price” means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on Emaanmall and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on Emaanmall. With respect to items sold by Emaanmall, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mis priced. If the correct price of an item sold by Emaanmall  higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mis priced item. We generally do not charge your credit card until after your order has entered the shipping process or, for digital products, until we make the digital product available to you.

12.7 APP PERMISSIONS

When you use apps created by Emaanmall, such as the Emaanmall App you may grant certain permissions to us for your device. Most mobile devices provide you with information about these permissions.

12.8 SANCTIONS AND EXPORT POLICY

You may not use any Emaanmall Service if you are the subject of Pakistan sanctions or of sanctions consistent with Pakistan law imposed by the governments of the country where you are using Emaanmall Services. You must comply with all Pakistan or other export and re-export restrictions that may apply to goods, software (including Emaanall Software), technology, and services.

12.9 OTHER BUSINESSES

Parties other than Emaanmall operate stores, provide services or software, or sell product lines through the Emaanmall Services. In addition, we provide links to the sites of affiliated companies and certain other businesses. If you purchase any of the products or services offered by these businesses or individuals, you are purchasing directly from those third parties, not from Emaanmall. We are not responsible for examining or evaluating, and we do not warrant, the offerings of any of these businesses or individuals (including the content of their Web sites). Emaanmall does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.

12.10 DISCLAIMEROF WARRANTIES AND LIMITATION OF LIABILITY

THE EMAANMALL SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE EMAANMALL SERVICES ARE PROVIDED BY EMAANMALL ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. EMAANMALL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE EMAANMALL SERVICES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE), OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE EMAANMALL SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE EMAANMALL SERVICES IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY LAW, EMAANMALL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 12.11 DISPUTES

Any dispute or claim relating in any way to your use of any Emaanmall Service will be adjudicated in the province Punjab,Lahore High Court Pakistan and you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.

12.12 APPLICABLE LAW

By using any Emaanmall Service, you agree that applicable federal law, and the laws of the province Punjab , without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Emaanmall

12.13 SITE POLICIES, MODIFICATION, AND SEVERABILITY

Please review our other policies, such as our pricing policy posted on this site. These policies also govern your use of Emaanmall Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

13 How Secure Is Information About Me?

We design our systems with your security and privacy in mind.

• We work to protect the security of your personal information during transmission by using encryption protocols and software.

14 What About Advertising?

• Third-Party Advertisers and Links to Other Websites: Emaanmall Services may include third-party advertising and links to other websites and apps. Third-party advertising partners may collect information about you when you interact with their content, advertising, and services. • Use of Third-Party Advertising Services: We provide ad companies with information that allows them to serve you with more useful and relevant Emaanmall ads and to measure their effectiveness. We never share your name

  or other information that directly identifies you when we do this. Instead, we use an advertising identifier like a cookie, a device identifier, or a code derived from applying irreversible cryptography to other information like an email address. For example, if you have already downloaded one of our apps, we will share your advertising identifier and data about that event so that you will not be served an ad to download the app again. While we do not share your specific shopping actions like purchases, product views, or searches with ad companies, we may share an advertising identifier and an estimate of the value of the ads they show you on our behalf so they can serve you with more effective Emaanmall ads. 15 Interest-Based Ads

16 What sort of information do we use to show interest-based ads?

To serve you interest-based ads, we use information such as your interactions with Emaanmall sites content, or services. We do not use information which on its own identifies you, such as name or e-mail address, to serve interest-based ads.

• You may adjust your personalized advertising preferences by visiting your ads privacy

• The Help feature on most browsers and devices will tell you how to prevent your browser or device from accepting new cookies or other identifiers, how to have the browser notify you when you receive a new cookie, or how to block cookies altogether. 20 Are Children Allowed to Use Emaanmall Services?

Emaanmall does not sell products for purchase by children. We sell children’s products for purchase by adults. If you are under 18, you may use Emaanmall Services only with the involvement of a parent or guardian. We do not knowingly collect personal information from children under the age of 13 without the consent of the child’s parent or guardian.

21 Conditions of Use, Notices, and Revisions

If you choose to use Emaanmall Services, your use and any dispute over privacy is subject to this Notice and our Condition of Use including limitations on damages, resolution of disputes, and application of the law of the state of Pakistan . If you have any concern about privacy at Emaanmall please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Notice will change also. You should check our websites frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
